Terms of Use (EULA)

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the digital signage services AdCast website, AdCast App and AdCast Player (collectively, the "Service") provided by TIMONIX DOO ("AdCast", "we", "our" or "us"), located at Carkovacka 30v, 34206 Donja Sabanta, Serbia.
If you obtain an AdCast application from the Apple App Store, the applicable Apple Media Services terms also apply to that application. If you obtain an AdCast application from Google Play, the applicable Google Play terms also apply. Mandatory platform terms govern only to the extent they apply and conflict with these Terms.
By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you obtain an application through an app store, the applicable store terms also apply. If you do not agree or lack authority to bind your organization, you must not use the Service.
2. Relationship with Apple
You acknowledge that:
- These Terms are between you and TIMONIX DOO, not Apple.
- Apple is not responsible for the Service, its content, or its availability.
- Apple has no obligation to provide maintenance, support, or warranty for the Service.
- To the maximum extent permitted by law, Apple disclaims all warranties with respect to the Service.
Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
3. Description of the Service
The Service allows registered users to:
- Upload and manage photos, videos, and media files
- Create custom ads using in-house templates, stickers (SVG), and animations
- Organize ads into playlists
- Cast or play ads on supported devices via AdCast Player
The Service is a subscription-based software service. We do not sell physical goods or hardware under these Terms. The Service is intended for individuals 18 years and older for personal or business use.
4. License Grant
Subject to these Terms and the Apple EULA, AdCast grants you a limited, non-exclusive, non-transferable, revocable license to use the Service on any Apple-branded device you own or control, as permitted by the Apple EULA.
5. Definitions
AdCast Platform refers to our web-based and mobile application-based digital signage content management system available at https://www.adcast.app.
Authorized User means any employee, contractor, or agent who is authorized by the Customer to access and use the Services under the Customer's account.
Registered Device or Player refers to any compatible hardware device (such as an Android TV box) registered to run the AdCast software.
Services encompasses all tools, features, and infrastructure provided by AdCast, including software, APIs, portals, and related support.
Subscription Term means the duration of the Customer's access to the Services, as specified in the chosen subscription plan.
6. User Accounts, Account Creation and Security
You must provide accurate registration details and safeguard your account credentials. You are responsible for all activity under your account. Notify AdCast immediately of unauthorized use. Apple is not responsible for account management or security.
To access the full features of the Service, you must:
- Create an account using a valid email address and password
- Keep your login credentials secure and confidential
You are responsible for all activity under your account and must maintain the confidentiality of your login credentials. AdCast is not liable for losses due to unauthorized use. You agree to notify us immediately of any unauthorized access or security breach.
7. User Content and Conduct. Use Restrictions
You retain ownership of the content you upload or create ("User Content"). By uploading content, you grant TIMONIX DOO a limited, non-exclusive, royalty-free license to store, process, and display your content solely to provide the Service.
You agree not to upload, publish, or share any content that:
- Violates any law or regulation
- Uploads unlawful, harmful, or infringing material
- Infringes on third-party intellectual property rights
- Is obscene, harmful, abusive, or misleading
- Includes malware or harmful code
We reserve the right to remove any content that violates these Terms or applicable law.
You shall not:
- Circumvent system protections, decompile, reverse-engineer, or attempt to extract source code.
- Copy, modify, or create derivative works of the Services.
- Distribute or sublicense the Services without prior written consent.
- Upload any content that violates laws or third-party rights.
- Circumvent access controls or exploit the system for unintended purposes.
- Share, resell, or sublicense the Service
8. Intellectual Property
Everything you see in the AdCast platform - like our logos, templates, stickers, animations, and other creative elements - belongs to TIMONIX DOO or is licensed to us. These materials are protected by copyright and trademark laws.
Please don’t copy, change, share, sell, or reuse any part of our services or content unless you have written permission from us.
All the rights to our software, designs, brand, and documentation remain with AdCast or our partners. You’re not allowed to use the AdCast name or logos unless we’ve given you written approval first.
9. Device Usage Policy
Each paid Display subscription permits use of the Service on one Registered Device for the applicable paid subscription period. A subscription grants a limited right to use the software service; it does not transfer ownership of software, hardware, or any other physical goods to you.
10. Disclaimers
The Service is provided "as is" and "as available". Your use of the service is at your sole risk. The Service and the information, services, products, programs and materials available through it are provided on an “as is” and “as available” basis. Use of the Service is at your own risk. We disclaim all warranties, express or implied, to the fullest extent permitted by law. AdCast does not guarantee that the Service will be:
- Error-free or uninterrupted
- Compatible with every device or system
- Suitable for any specific purpose
To the fullest extent permissible pursuant to applicable law, AdCast and its affiliates expressly disclaim all warranties of any kind whether express or implied, including but not limited to any warranties of title, or implied warranties of merchantability, fitness for a particular purpose and non-infringement.
AdCast does not make any warranty that (A) the service or its content will meet your requirements, or (B) that the service will be uninterrupted, timely, secure, or error free, or (C) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, or (D) that defects, if any, will be corrected. You agree that AdCast shall have no responsibility for any damages suffered by you in connection with the service or any content contained therein.
You expressly agree that use of this service, including all content, data or software distributed by, downloaded or accessed from or through this service, is at your sole risk. You understand and agree that you will be solely responsible for any damage to your business, your computer system or loss of data that results from the download of such content, data and/or software.
You acknowledge that AdCast does not control in any respect any information, products, or services offered by third parties on or through this service. Except as otherwise agreed in writing, AdCast and its affiliates assume no responsibility for and make no warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of content or products distributed or made available by third parties through this service.
You acknowledge that AdCast makes no warranty or representation that confidentiality of information transmitted through this service will be maintained.
No advice or information, whether oral or written, obtained by you from AdCast or through or from the service shall create any warranty not expressly stated in the agreement.
Apple makes no warranties regarding the Service. Use of the Service is at your own risk. We disclaim all warranties, express or implied, to the fullest extent permitted by law.
11. Limitation of Liability
To the fullest extent permitted by law, TIMONIX DOO shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Any loss of data, revenue, profits, or business opportunity
- Any damages arising from unauthorized access to your content or account
To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Service is limited to the subscription fees actually paid to us for the affected Display during the 12 months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
12. Third-Party Services
The Service uses third-party services including:
- Firebase (Google) for analytics and notifications
- Sentry for error/crash reporting
Your use of these features is also governed by the respective third-party terms and privacy policies.
13. Subscription Term, Renewal and Cancellation
Customers may select a monthly or annual paid subscription for each Display. Subscription fees are paid in advance for the selected subscription period. Unless the purchase flow expressly states that a plan is non-renewing, a paid subscription renews automatically at the end of each billing period unless cancelled before the renewal date through the payment channel used for purchase.
A paid Display may use the paid features through the end of its current paid subscription period. Cancellation prevents a future renewal charge but does not end access before that period expires. Any free trial or introductory offer is governed by the duration, price after the offer, renewal terms, and cancellation instructions shown in the applicable purchase flow. If a free plan is offered, its features, limits, and availability are shown at signup and may differ from paid plans.
14. Fees, Payment and Price Changes
Fees, the billing period, whether a subscription renews automatically, and the amount due at each renewal are shown before purchase. Payments may be processed through the Apple App Store, Google Play, Stripe, RevenueCat, or another authorized payment provider, depending on the purchase channel. Purchases made through an app store are also subject to that platform’s applicable billing, cancellation, price-change, and refund rules.
Except where required by applicable law or the policy of the relevant app store or payment provider, subscription fees are non-refundable. We do not provide pro-rated refunds for unused time, cancellation, downgrade, or non-use of the Service. Customers are responsible for applicable taxes. Failure to pay may result in suspension or termination of the affected paid features.
We may change prices for a future subscription period. We will provide any notice, obtain any consent, and apply any timing required by applicable law or the relevant payment platform. A price change will not alter fees already paid for the current paid period.
15. Customer Responsibilities
Customers must:
- Ensure hardware compatibility and network reliability.
- Prevent unauthorized access to Services.
- Comply with applicable laws and regulations.
- Provide accurate content and obtain necessary permissions for uploaded materials.
16. Data Privacy and Content
Use of the Service requires collection and processing of data in accordance with our Privacy Policy. Apple is not responsible for AdCast’s handling of your data.
By using the Services, you consent to our handling of personal and operational data.
You retain ownership of content you upload. You grant AdCast a limited license to host and display your content solely for the purpose of providing the Services.
17. Third-Party Integrations
Our Services may interface with third-party services or software. AdCast is not responsible for the functionality, terms, or content of such third-party tools.
Canva Integration
AdCast provides an integration with Canva, a third-party service, that lets you export Canva content you select to your AdCast account. By connecting the services and initiating an export, you authorize AdCast to receive the selected exported content, process and store it in your AdCast account, create an Ad when you enable that option, and add the Ad to a compatible playlist when you request it.
Use of the Canva integration does not transfer ownership of your designs or other content to AdCast. You remain responsible for ensuring that you have all rights needed to use, export, publish, and display the content through AdCast, including compliance with applicable Canva terms and licenses. Your use of Canva and its content or features is subject to Canva's Terms of Use and Privacy Policy.
The integration may depend on Canva APIs and services, AdCast services, account authorization, and supported formats or features. Changes to, limitations of, or outages affecting third-party services may affect availability. You may disconnect the integration through available Canva app/account controls or AdCast integration controls. Disconnecting prevents future connected operations but does not necessarily remove content previously exported to AdCast; imported Media, Ads, and playlist assignments can be managed through normal AdCast account functionality.
18. Warranties and Disclaimers
We warrant that:
- We have legal authority to offer these Services.
- The Services will function substantially as described in documentation.
Except as expressly provided, the Services are provided "as-is" without additional warranties. AdCast disclaims all other warranties, including implied warranties of merchantability or fitness for a particular purpose.
19. Consumer Rights
Nothing in these Terms is intended to limit or exclude mandatory consumer protection rights, remedies, or jurisdiction rules that apply to you. Where applicable law requires a right of withdrawal, refund, remedy, or a different forum, that law prevails over conflicting provisions of these Terms.
20. Indemnification
You agree to indemnify AdCast against claims arising from your misuse of the Services, breach of these Terms, or violation of third-party rights.
21. Suspension, Termination and Data
We may suspend or terminate your account for breach of these Terms. You may cancel a subscription through the payment channel used for purchase, such as your App Store or Google Play account where applicable. Cancellation prevents future renewal charges; the affected paid Display remains entitled to use the paid features until the end of its current paid subscription period. Upon expiry of that period or termination for breach, the license to use paid features ends.
Either party may terminate this Agreement with notice if the other party materially breaches its terms. Termination may also occur due to insolvency, illegal activity, or non-payment.
Upon termination:
- Access to Services will end.
- Customer data may be deleted or anonymized in accordance with our Privacy Policy, applicable customer agreement, documented retention procedures, and applicable law.
- Outstanding payments remain due.
- Free plan users may continue with limited access unless they request account deletion.
22. Confidentiality
Both parties agree to maintain the confidentiality of sensitive business or technical information shared under this Agreement.
23. Force Majeure
Neither party shall be liable for failure to perform due to causes beyond reasonable control, including natural disasters, war, or telecommunications failure.
24. Marketing and Publicity
For business customers, you grant AdCast permission to list your organization as a customer and use its name and logo in marketing materials unless you opt out in writing. We may use anonymized and aggregated use cases without identifying you or your organization. We will not use an individual consumer’s name or likeness for marketing without appropriate permission.
25. Assignment
You may not assign this Agreement without AdCast's prior consent. We may transfer this Agreement in connection with a merger or sale.
26. Entire Agreement
This Agreement, along with our Privacy Policy and any applicable orders or addendums, constitutes the complete agreement between the parties.
27. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts in the Republic of Serbia.
If you are a consumer, nothing in these Terms limits or excludes any mandatory consumer protection rights or jurisdiction rules available to you under the laws of your country of residence. Where mandatory law permits you to bring proceedings before the courts of your place of residence, this jurisdiction clause shall not restrict that right.
28. Copyright Infringement Notices
If you believe that copyright-protected work has been used without authorization on our platform, you may send a copyright infringement notice to:

- Your contact details
- A description of the copyrighted work
- The location of the infringing content
- A statement under penalty of perjury of your ownership

29. Amendments to Terms
We may update these Terms to reflect legal, technical, security, or business changes. We will post the updated Terms with a revised effective date and, for material changes, provide reasonable advance notice through the Service or your registered email where reasonably practicable. Material changes to a paid subscription will apply prospectively, ordinarily from the next renewal, unless immediate change is required for security, law, or the applicable payment platform. Continued use after the effective date constitutes acceptance only to the extent permitted by applicable law.
